Terms and Conditions

These Event and Booking Terms ("Booking Terms") govern the booking of artists, DJs, event organization services, and stage participation through THIRD KAGURA Pty Ltd ("THIRD KAGURA", "we", "us") and its affiliated platforms.

By submitting a booking enquiry or confirming a booking, you ("Client", "you") agree to these terms.

01Scope of Services

Bookings may include, but are not limited to:

• DJ performances
• Live event organization
• Stage production and management
• Promotional collaborations via our social media service
• Other entertainment-related services as agreed in writing

02Booking Process

2.1 Enquiry

• Bookings begin with a written enquiry submitted via thirdkagura.com or through an authorised contact.

2.2 Confirmation

A booking is confirmed only upon:

1. Written acceptance of the service quote
2. Receipt of any required deposit
3. Signature of a booking agreement (where applicable)

2.3 Deposit

• A non-refundable deposit (typically 30–50% of total fee) may be required to secure the booking.
• The balance is payable as specified in the booking agreement.

03Cancellation Policy

3.1 By the Client

In the unlikely event we must cancel, we will:

• Refund all payments made
• Use reasonable efforts to provide a replacement of equal standing

We are not liable for indirect costs (venue, marketing, third parties).

3.3 Force Majeure

• Neither party shall be liable for failure to perform due to events beyond reasonable control (natural disasters, pandemics, government restrictions, etc.).
• In such cases, we will negotiate in good faith to reschedule or refund.

04Client Obligations

The Client agrees to:

1. Provide accurate event details (date, venue, audience, technical requirements)
2. Ensure the venue meets safety, legal, and technical specifications
3. Obtain all necessary licenses, permits, and insurances
4. Provide hospitality and rider items if agreed
5. Ensure timely access to the venue for setup and soundcheck

05Performance Conditions

5.1 Technical Rider

• Where supplied, technical and hospitality riders form part of the booking agreement.
• Failure to meet rider specifications may result in reduced performance or, in serious cases, cancellation without refund.

5.2 Set Length and Format

• Performance length is as agreed in the booking confirmation.
• Encore or extension performances are at the artist's discretion.

5.3 Recording and Broadcasting

• Recording, streaming, or broadcasting of performances requires prior written consent.
• Unauthorized recording may result in legal action.

06Promotional Materials

• THIRD KAGURA and its artists may use event imagery, audio, and video for promotional purposes unless otherwise agreed in writing.
• The Client grants permission to use the event name, venue, and date in promotional materials.

07Conduct and Safety

THIRD KAGURA reserves the right to discontinue a performance if:

• Audience or crew safety is compromised
• Equipment is damaged
• The Client materially breaches these Terms

In such cases, full fees remain payable.

08Liability

• THIRD KAGURA's liability is limited to the total fees paid for the affected booking.
• We are not liable for indirect, incidental, or consequential damages, including but not limited to lost ticket sales, event disruption, or third-party claims.
• Nothing in these terms excludes rights under the Australian Consumer Law that cannot be excluded.

09Indemnification

The Client agrees to indemnify and hold harmless THIRD KAGURA, its artists, and representatives against any claims, damages, or losses arising from the event, except where caused by THIRD KAGURA's negligence or willful misconduct.

10Social Media Service

For collaborations involving our social media service:

• Artist content (photos, biography, history) remains the property of the artist.
• THIRD KAGURA is granted a license to host and display the content as outlined in our Terms of Service.
• Bookings facilitated through the platform follow the same terms as direct bookings.

11Confidentiality

Each party agrees to keep confidential any non-public information disclosed during the booking process, including fees, technical details, and personal contact information.

12Privacy

Personal information collected during booking is handled in accordance with our Privacy Policy.

13Governing Law

These Booking Terms are governed by the laws of New South Wales, Australia. Any disputes shall be resolved in the courts of New South Wales.
